Bending the Burden: Navigating Illinois Workers’ Compensation Claims in the wake of COVID-19 rule changes (Webinar)
The Illinois Workers’ Compensation Commission recently adopted an emergency rule stating that in cases where a COVID-19 First Responder or Front-Line worker is injured or has a period of incapacity resulting from exposure to COVID-19, the exposure will be “rebuttably presumed” to have arose out of and in the course of the employment, and will further be “rebuttably presumed” to be causally connected to the “hazards or exposures” of the petitioner’s COVID-19 First Responder or Front-Line Worker employment. This webinar will outline the amended rule changes, anticipated effects on workers’ compensation claims, and recommended steps for COVID-19 claim handling.

Amelia Schwingle is a Partner at Brady, Connolly & Masuda, P.C., specializing in the defense of workers’ compensation claims for employers, insurers and third-party administrators throughout the State of Illinois. Amelia previously represented injured workers, so she is well rounded in assessing workers’ compensation strategy from both sides of the bar. Amelia’s experience includes arguing matters at the Arbitration level, the Commission, the Circuit Court, and the Illinois Appellate Court. She is currently a Member of the Board of Directors of the Workers’ Compensation Law Association and a Member of Brady Connolly & Masuda’s COVID-19 Task Force. Amelia obtained her undergraduate degree from the University of Notre Dame and her law degree from the University of Illinois College of Law.
